The story of the first Pilgrim thanksgiving is commemorated as a national holiday, while the Boston Tea Party and Paul Revere's ride have passed into the national mythology. Even the grimmer aspects of the American experience-Indian warfare and the conquest of an ever expanding frontier-were part of the early history of Massachusetts.

In this book, Richard D. Brown and Jack Tager survey the rich heritage of this distinctive, and distinctly American, place, showing how it has long exerted an influence disproportionate to its size. A seedbed of revolt against British colonial rule, Massachusetts has supplied the nation with a long line of political leaders-from Samuel and John Adams to William Lloyd Garrison and Lucy Stone to John, Robert, and Edward Kennedy. Its early textile mills helped shape the industrial revolution, while its experiences with urbanization, immigration, ethnic conflict, and labor strife reflected the growth of the national economy. In the twentieth century, the state continued to lead the country through a series of wrenching economic changes as it moved from the production of goods to the provision of services, eventually becoming a center of the high-tech revolution in telecommunications.

If there is one common theme in the Bay State's history, Brown and Tager make clear, it is the capacity to adapt to change. In part this trait can be attributed to the state's unique blend of resources, including its many distinguished colleges and universities. But it can also be credited to the people themselves, who have created a singular sense of place by reconciling claims of tradition with the possibilities of innovation. This book tells their story.

Exploring the complexities and contradictions in how samples are licensed, Kembrew McLeod and Peter DiCola interviewed more than 100 musicians, managers, lawyers, industry professionals, journalists, and scholars. Based on those interviews, Creative License puts digital sampling into historical, cultural, and legal context. It describes hip-hop during its sample-heavy golden age in the 1980s and early 1990s, the lawsuits that shaped U.S. copyright law on sampling, and the labyrinthine licensing process that musicians must now navigate. The authors argue that the current system for licensing samples is inefficient and limits creativity. Born, raised, and retired in Mississippi, Lucy Somerville Howorth (1895-Â–1997) was a champion of the rights of women long before feminism emerged as a widely recognized movement. As told by Dorothy S. Shawhan and Martha H. Swain, hers is a remarkable life story--from a small-town upbringing to a career as an attorney, an activist, and the last survivor of the New Deal women in Washington, D.C. She held a presidential appointment under every chief executive from Franklin Roosevelt to John Kennedy.
Howorth was a fervent believer in the power of organizations to bring about change, and she became known for her leadership qualities, acumen, and quick appraisal of social problems, particularly as they affected women. Shawhan and Swain point out that her winsome personality, small stature, and delightful sense of humor also aided her as a female aspiring in a man's world. In 1931 she was elected to the Mississippi House of Representatives and after campaigning for Roosevelt was rewarded by the new president with a federal appointment. She served in a number of subsequent positions, rising to become general counsel of the War Claims Commission, at that time the highest legal position in an executive commission ever filled by a woman.
Howorth worked relentlessly for the advancement of women, especially through the American Association for University Women and the National Federation of Business and Professional Women. She lobbied for equality in the workplace, helping to effect significant advances in government and the professions. In 1944, at the request of Eleanor Roosevelt, Howorth delivered the keynote address at the White House Conference on Women in Postwar Policy-Making, the most memorable of her many public addresses.

The first-ever biography of Howorth bestows long-overdue recognition of her many notable achievements and illuminates the activism of women in the decades often considered to be the doldrums of the women's movement.

The explanation lies primarily in the psychological effects of the way that lawyers think about law and judging. The instincts ingrained by the experiences common to legal education and the successful practice of law also work to encourage the reckless use of power. Nagel argues that the problem with the modern judicial role is cultural and political. He demonstrates that judges, especially Supreme Court justices, have degraded our political discourse, intensified social conflict, and drained moral confidence. By examining modern Supreme Court confirmation hearings along with certain classic legal writings, Nagel shows how modern lawyers have a broad consensus on how to interpret the Constitution and, more generally, how to think about law. One major component of this mindset is to combine realism with legalism in ways that naturally tend to expand the judiciarys imperial role. Realism counsels that decisions are inevitably partly personal and therefore cannot be conclusively justified while legalism imparts the sense that the judges interpretation is the best one possible. This combination of the personal and political, along with other aspects of modem legal thinking and training, means that judges are not only unconstrained by professional norms but actually are impelled by them to use power expansively.
